The system took too long and she "aged out" in March. She has lived here all her life and has her green card. What is the process now to her citizenship? <br />We will be adopting her younger sisters, one is 16 and an immigrant without her green card. Postnuptial agreements...Re: Postnuptial agreements<br /><br />Postnuptial agreements are also known as marital agreements, they happen after the couple gets married. Sometimes, immigrants sign these to obtain the cooperation a US citizen or LPR spouse who does not seem "motivated" to file immigration paperwork for the other spouse. Signing one can also put the other spouse's mind at ease that the immigrant has married them for love, not for immigration purposes (to get a green card). However, postnuptial agreements can also be used against an immigrant just as prenuptial agreements (those that happen prior to marriage) can be. The same considerations apply. There are considerations that CIS is going to understand - if this is a second marriage and there are young children from the first marriage, it would be reasonable for the USC spouse to want to leave their assets to their young children instead of primarily to their spouse. However, the same considerations with all spouse-based immigrant visa cases apply - the more you commingle your assets and financials, the more likely CIS is going to believe it is a real, bona fide relationship and marriage. If there is no financial risk to the US citizen or the immigrant spouse, then CIS is not going to be as convinced. <br /><br />Always consult a licensed, experienced immigration attorney before you sign anything like this and if you have already signed such an agreement, pass it by an immigration attorney to review to identify any issues that could come up at your green card interview or conditional green card waiver interview if your relationship later falls apart.Anonymoushttps://www.blogger.com/profile/17525869965240842380noreply@blogger.comtag:blogger.com,1999:blog-34138161.post-5397396031856351372013-04-13T08:34:38.599-07:002013-04-13T08:34:38.599-07:00Never encourage a fiance or spouse to enter the US...Never encourage a fiance or spouse to enter the US on a temporary visa such as a tourist visa with the intent of overstaying that visa or moving to the US on that visa. That can easily be considered visa fraud (lied about intent to get the visa and/or lied at entry) and could bar your fiance or spouse based on misrepresentation and implicate you, as their spouse if you are involved, with fraud with civil and criminal action. Misrepresentation can be a lifetime bar with only a limited waiver available in certain circumstances. Always consult a licensed, experienced immigration attorney about the right way to have a loved one immigrate. <br /><br />With that being said, it may be possible to overstay a visa (although you are exposing yourself to ICE to be picked up and deported) and still be able to adjust your status in the US as the spouse of a US citizen but you will still run into a potential fraud finding as well as other considerations. Generally, an I-130 receipt may not be enough; it depends on whether the case was "approvable when filed" and district offices vary as to how much they look into this requirement (i.e., was the necessary relationship there? was fraud implicated? if denied, why?). Plus, if you are not the direct beneficiary of the I-130 (i.e., your spouse or parent filed for you), then you may have difficulty proving grandfathering as a derivative. Always consult an attorney about your particular situation and the attorney will have more time to discuss your facts in detail. Good luck!
